Modification of the Denomination of Truth Commission
to Truth
and Reconciliation Commission
SUPREME DECREE
N° 101-2001-PCM
THE CONSTITUTIONAL PRESIDENT OF THE REPUBLIC
WHERE AS:
Supreme Decree N° 065-2001-PCM created the Truth Commission
with a mandate to examine the process, facts and liabilities
of terrorist violence and human rights violations from May
1980 to November 2000, by either terrorist organizations and
State agents; and to propose initiatives aimed at strengthening
peace and harmony among Peruvians;
One of the essential goals of the Commission is laying the
foundations for in-depth national reconciliation, clarifying
facts, and restoring justice;
It is appropriate to change the name from Truth Commission
to Truth and Reconciliation Commission;
Pursuant to Article
4 of said regulation, it is established that the Truth Commission
will sit seven members, all Peruvian
nationals, reputed ethical background, prestige and legitimacy,
and committed to the defense of democracy and constitutional
institutions. They will be appointed by the President of
the Republic by a Supreme Resolution, with the approval of
the
Cabinet of Ministers;
It is appropriate to increase the number
of Commission members to twelve, in order to include personalities
who comply with
the above requirements and can help in fulfilling the ambitious
goals that have been set for coming months. Given the importance
of the Commission’s tasks it is appropriate to extend
its term, as foreseen in Article 7 of the above Supreme Decree;
Pursuant to section 24) of Article 118 of the Political Constitution
of the State and Legislative Decree N° 560 – Executive
Power Law:
With the approval of the Cabinet of Ministers ;
WHEREOF:
Article 1.- To change the name of the Truth Commission, created
by Supreme Decree N° 065-2001-PCM, to TRUTH AND RECONCILIATION
COMMISSION.
Article 2.- To modify Article 4 of Supreme Decree N° 065-2001-PCM,
which reads as follows:
“Article 4.- The Truth and Reconciliation Commission
sits a maximum of twelve members, all Peruvian nationals, of
reputed ethical background, prestige and legitimacy and committed
to the defense of democracy and Constitutional institutions.
The
President of the Republic, with the approval of the Cabinet
of Ministers shall appoint the Commission members by Supreme
Resolution countersigned by the Cabinet Chief”.
Article 3.- To grant the Truth and Reconciliation Commission
an additional 30 days to organize its work and prepare the
corresponding regulatory documents. This additional term is
granted notwithstanding the eighteen months mentioned in Article
7 of Supreme Decree N° 065-2001-PCM.
Article 4.- This Supreme Decree is countersigned by the Cabinet
Chief, and the Ministers of Defense, Internal Affairs, Justice
and Foreign Affairs.
